Amazon says it no longer uses nondisclosure agreements with the government agencies it works with on data center projects. The change came in a Friday, Oct. 2, [post](https://www.aboutamazon.com/news/company-news/amazon-data-centers-built-together?ref=implicator.ai) from Amazon Web Services CEO Matt Garman that also pledged more than $1 billion over five years to host communities. Garman presented the pledge as a response to what he counted as more than 100 moratoriums under consideration across the country, which he wrote could threaten the U.S. lead in artificial intelligence.

What Changed

- Amazon says it no longer uses nondisclosure agreements with the government agencies it works with on data center projects, a change that applies going forward only.
- AWS CEO Matt Garman pledged more than $1 billion over five years to host communities through a program called Built Together.
- The pledge averages about $200 million a year, roughly one-tenth of 1 percent of Amazon's projected $220 billion in 2026 capital spending.
- Stand.Earth called the funding "a drop in the bucket" but said ending NDAs would likely improve transparency.

## What the NDA pledge covers

The policy applies going forward. Amazon does not plan to revisit past agreements, most of which it says no longer apply once a project becomes public. Microsoft went further in March, saying it would terminate existing NDAs with local governments.

The announcement does not say whether contractors or other private counterparties are covered. In Wharton County, Texas, a top official [signed an NDA](https://www.wired.com/story/amazon-says-it-is-going-to-stop-using-ndas-for-data-centers/?ref=implicator.ai) with contractor VisionFirst Advisors that prevented him from sharing details about an Amazon project.

Days before Garman's post, Rep. Jamie Raskin sent letters to Amazon, Google, Meta and Oracle demanding information about their data center NDAs.

## The money

Built Together, Amazon's name for its five-year program of more than $1 billion, would cover community college costs remaining after financial aid for 300,000 students, Amazon estimates. Amazon plans 16 additional training centers on or near data center sites, beyond the three operating now and six more in development.

The program also targets energy-efficiency upgrades for more than 300 schools and community buildings and more than 30,000 homes. Local nonprofits and community foundations would receive flexible funding for priorities chosen by residents. “This is not Amazon deciding what communities need, it is Amazon providing resources and letting communities decide,” Garman wrote.

The pledge averages about $200 million annually, roughly one-tenth of 1 percent of Amazon's projected $220 billion in capital spending for 2026, largely for data centers and chips. Amazon says it contributed more than $1 billion to U.S. data center communities over the past three years.

Amazon has not published a funding breakdown beyond more than $100 million for community college endowments and roughly $100 million for training centers, itemizing roughly $200 million of the $1 billion. It also pledged annual energy and water reporting and Tier 4 backup generators at new sites, meeting what Amazon calls the cleanest EPA emission standard. Amazon's figures on water use and generator run time are self-reported.

## The objections

Stand.Earth [called the funding](https://arstechnica.com/tech-policy/2026/10/amazons-1b-plan-to-combat-data-center-backlash-draws-more-backlash/?ref=implicator.ai) “a drop in the bucket” against Amazon's spending and “a flailing attempt at damage control.” The environmental group said ending NDAs would likely improve transparency.

It also said Amazon is constructing the power plant in Pecos, Texas, tied to a planned Amazon data center and permitted to release 33 million tons of carbon dioxide annually, more than any other power plant in the United States. Amazon's commitments do not mention that project.

Garman cited reports of foreign countries seeding misinformation to slow U.S. data center construction. PolitiFact [found in September](https://www.geekwire.com/2026/amazon-pledges-1b-to-data-center-communities-warns-that-local-opposition-threatens-u-s-ai-lead/?ref=implicator.ai) that the role of foreign influence had been exaggerated, with little evidence the accounts reached a wide audience.

Data Center Watch, a group that tracks local data center disputes, counted at least 75 projects worth about $130 billion blocked or delayed in the first three months of 2026\. An Economist/YouGov poll in late August found 63% of Americans would oppose a data center in their community.

Garman wrote that electricity rates rose in some data center states, including Illinois and New York, and fell in others, including Indiana and Mississippi, blaming an aging grid. U.S. government data show residential electricity prices rose 13% in Virginia, 16% in Illinois and 12% in Ohio in August 2025 from a year earlier, compared with 6% nationally. Those three states have high concentrations of data centers.

“It is difficult to read this statement as anything other than a plea from Amazon to continue exploiting communities at minimal cost,” Stand.Earth said.
